For Solicitors - wording for your will

The wording for a will depends on the type of bequest you would like to leave.  We understand that loved ones come first, and we encourage you to discuss your intention with them before finalising your will.

Following is suggested wording for the various types of bequest: 

Residual bequest wording:

“I give all the rest of my real and personal property whatever and wherever situated to Spinal Cord Injuries Australia, ABN 93 001 263 734, 1 Jennifer Street, Little Bay NSW 2036 for its general purposes, free of all death and estate duties. I declare that the receipt of the Secretary or other authorised officer of Spinal Cord Injuries Australia shall be a sufficient discharge to my Executors.” 

Percentage of your estate:

“I give _______ per cent of my estate to Spinal Cord Injuries Australia, ABN 93 001 263 734, 1 Jennifer Street, Little Bay NSW 2036 for its general purposes, free of all death and estate duties. I declare that the receipt of the Secretary or other authorised officer of Spinal Cord Injuries Australia shall be a sufficient discharge to my Executors.” 

A percentage of the residue;

“I give _______ per cent of the residue of my estate to Spinal Cord Injuries Australia, ABN 93 001 263 734, 1 Jennifer Street Little Bay NSW 2036 for its general purposes, free of all death and estate duties. I declare that the receipt of the Secretary or other authorised officer of Spinal Cord Injuries Australia shall be a sufficient discharge to my Executors.” 

Specific gift bequest wording;

“I give the sum of $ or named item_______(eg. Shares, jewellery) to Spinal Cord Injuries Australia, ABN 93 001 263 734, 1 Jennifer Street Little Bay NSW 2036 for its general purposes, free of all death and estate duties.  I declare that the receipt of the Secretary or other authorised officer of the Spinal Cord Injuries Australia will be a sufficient discharge to my Trustee.”
